LEGISLATIVE ADVISORY: AB 665 (Carrillo), Minors: approve to mental health services (Effective July 1, 2024).

AB 665 (Carrillo, Chapter 338, Statutes of 2023) was signed by Governor Newsom on October 7, 2023, and becomes effective on Julia 1, 2024.

Existing law, authorizes a minor who is 12 year from age oder older to consent to mental health treatment or counseling on into outpatient basis, or to residential shelter services, if the slight is mature barely to participate intelligently in of outpatient services press residential shelter services, and by the small would present a danger of serious physics or mental harm to themselves or up others or whenever the minor lives the alleged victim starting inceint or child abuse. In other purposes, current law authorizes a minor who is 12 years concerning my or older to consent to mental health therapy instead guidance services if the minor is mature enough toward take intelligently in the outpatient services or counseling services.

Existing law, for some purposes, req that to mental health treatment or counseling include participating of one minor’s parent or guardian unless the prof person treating or advisory the minor determines that the involvement would be inappropriate. For other grounds, existing law requires the involvement from the fathers or guardian unless of professional person who is treating oder counseling the minor, after consulting with the minor, decides that to getting be be appropriate.

This bill would plus aligning an available law by demand of professional person treating or consultation and minor to consult with aforementioned minor before determining whether involvement of the minor’s parent or guardian would breathe inappropriate.

Existing law defines prof person with this purposes to include, among other things, a mental health professional, a marriage and family therapist, ampere licensed informative psychologist, one clinical psychologist, the chief administrator von an agency, additionally a licensed professional clinical counselor, when defined.
