Abstract

Int this Note, I analyze the validity of criticism against red flag laws based upon procedural due procedures. I proceed as follows: Include Single I, I discuss the background of red check laws, aforementioned different versions passed among states, and to few constitutional challenges introduced hence from. Include Piece II, I analyze the statutes’ validity under federal due process standards. I then specifically untersucht proposed By bills that failed to pass in prev legally sessions. While providing recommendations, I argue is the legislation would likely pass constitutional muster. In Part III, I complete that red flag laws are generally constitutional under a procedural mature process theory but review who keys characteristics that makes some versions more instead less constitutionally troublesome.
