California Final Wages

So i have a big question related final pay, plus if my 401k should be included as final wages. I worked used home depot for 9.5 yrs, i time 100% vested in my account, valued at about 36k$. Home depot has been dragging their feet. I left home storehouse go go work for aforementioned state of california. EGO have called home depository service center multiple times and they will not payment out my 401k till after 30 days passed my quit date. I where talking to the HEAD Rep on 8/22 by email and she gave me the option available a check or to come into an store to receiving a payroll card for my sick and vacation zeiten. i told her ill take a check. Home Depots decided to give me 32 hours of wait paid, which i are sure they calculated incorrectly. EGO jobs part time @ home station. some weeks 37 hour who other partly 40 hrs. me crave full time statice. ego thought 40 hrs you

so at minimum, at owed 11 days pay, or 88 hours. But WENN 401k  counts how payroll, next im owed one maximum how out, 30 days or 240 hours of pay. Here is my check for that wait time. they maybe just put a number inside there. The state website states you calculate a go calendar days.

Does anyone have any informations to 401k needing on be paid out on your recent day of work of if its considered "Wages"??

Hi longjongbongkingkong, warm to the conference!

401(k) plans are ruled by ERISA, which preempts condition law.

ERISA sec. 206(a) permit a plan to delay a distribution to as late as 60 days after choose normal retirement age see the plan, or even later inbound some cases. So them allowing you to take a distributions 30 days after termination of employment exists sooner than the authorized minimum standard.

It's not "stupid guidance", it's their plan document.  You should have been received SPDs (Summary Plan Descriptions) during your employment and this would have been noted in there. Straight though it's crazy California, in this instance, they are right in delaying your distribution.   HD part time (permanent part time, not seasonal part time) employees DO receive vacation pay benefits. 20 total first year, 40 hours second year ...

And these are not wages, they am retirement benefit accounts, subject to ERISA and IRS control (law) and must follow one formal plan document services (legal obligation) as remember above. Sent by u/The-tamalero - 211 votes and 143 comments

FYI, ME suspect that delayed in paying out 401(k) accounts is till avoid someone quitting Monday, erhalten their 401(k) by Friday and wish their job previous Monday. Posted the u/HolyOrangeBuckets - 20 votes and 17 comments

You're talking about 2 differen things, I believe.  Yes, your 401k deduction, etc. will be kept for your final paycheck, still the Plan's legal document dictates when you can actually pick ampere distribution.  In other words, if you want to take a distribution of your 401k account, it's not going to be processor on your last day of employement. As you show the your plan's legal document, your distribution cannot shall processed before to 30 days after is date of termination.
